Terms Of Business

Price

1. The price shall be increased by the amount of GST except where expressly included in the quotation given.
2. Alterations to any price shall be effective from the date specified at the time of giving notice to the Buyer.

Payment (Licensed and Subscription-Based Product and Services)

1. Licenced and subscription based products are billed monthly or annually at the agreed rate.
2. Unless expressly amended in the quotation, payment in full will be made on or before the annual anniversary date of the commencement of the service or licence.
3. An invoice only will be issued, in the name of Flashpoint Limited and payment must be made on this invoice. In certain circumstances, the Buyer may be invoiced by a registered dealer, who then, in turn, will be invoiced by Flashpoint Limited.
4. If the Buyer defaults on payment Flashpoint Limited may suspend the service or licence until such time as payment is made. Flashpoint may also charge a default penalty at a rate per annum equal to the retail lending base rate at the ASB Bank and calculated on a daily basis on the unpaid portion of the price from due date until payment in full.
5. If a credit or debt collection agency is required to obtain payment any costs charged by the agency in the course of collection of outstanding monies owed by the Buyer, including commissions, will be on charged and paid by the Buyer.

Payment (Bespoke Work)

1. Unless expressly amended in the quotation, payment in full will be made on the delivery of goods and service.
2. An invoice only will be issued, in the name of Flashpoint Limited and payment must be made on this invoice. In certain circumstances, the Buyer may be invoiced by a registered dealer, who then, in turn, will be invoiced by Flashpoint Limited.

Returns Policy

1. You may request a refund on software purchases within 30 days of receipt of your purchase. To request a refund please contact us.
2. We can not accept returns on items more than 30 days after the original purchase or on bespoke or quoted development.

Use Of Information

1. The Buyer agrees that Flashpoint Limited may use any information it has about the Buyer relating to their credit worthiness and give that information to any other person, including any credit or debt collection agency for credit assessment and debt collection purposes.
2. Flashpoint Limited agrees that other information gathered about the Buyer is to remain confidential to Flashpoint Limited.
3. If the Buyer is an individual, the Buyer has rights under the Privacy Act 2020 to access and request the correction of any personal information that Flashpoint Limited holds about the Buyer.
